Terms of Use

Welcome to Selectr AI ("Selectr", "we", "us", or "our"). These Terms of Use ("Terms") govern your access and use of Selectr AI as a client (employer or recruiter). By creating an account or otherwise accessing our services, you agree to be bound by these Terms.

If you do not agree, please do not use the platform.

1. Definitions

- "Client" / "you" means an individual or entity using Selectr AI to evaluate or recruit candidates.
- "Candidate Data" means any CV, interview, assessment, transcript, or other data relating to candidates.
- "Services" means the Selectr AI platform, tools, and content offered to clients.
- "Controller" is used as defined in the General Data Protection Regulation (GDPR).
- "Interview Credits" means the monthly allocation of interviews included in your subscription plan.

2. Eligibility

You may use Selectr AI as a Client if you are:

- A legal entity or company;
- A freelancer or sole proprietor;
- An individual using Selectr for legitimate hiring purposes.

If you represent an organization, you confirm that you are authorized to bind your organization to these Terms.

3. Description of Services

Selectr AI offers AI-powered recruitment tools to:

- Analyze candidate CVs and interviews via LLMs;
- Provide summaries and evaluations;
- Assist in matching candidates to open positions.

You will receive:

- Access to candidate data and evaluation tools;
- Dashboards for reviewing and managing applications;
- Support features for improving hiring workflows.

4. Data Protection & Controller Status

Under GDPR, both you and Selectr are independent data controllers:

- Selectr is a controller for candidate data prior to sharing it with you;
- You become a controller of that data upon receipt.

Each party is solely responsible for its own compliance with applicable data protection laws, including legal basis for processing, security, and data subject rights.

We may provide a Controller-to-Controller Data Sharing Agreement upon request.

5. Client Responsibilities

You agree to:

- Use candidate data only for legitimate recruiting purposes;
- Comply with all laws including data protection, labor, and anti-discrimination regulations;
- Not store or reuse candidate data beyond reasonable recruiting timelines;
- Not contact or profile candidates outside the context of the hiring process.

6. Use Restrictions

You may not:

- Sell, license, or transfer candidate data to third parties;
- Use the platform to build competing services;
- Misuse, reverse-engineer, or modify the platform without authorization;
- Use the platform for unlawful, discriminatory, or unethical activities.

7. Fees and Payment

7.1 Subscription Plans
Selectr AI offers the following subscription plan:
- One Plan: $99 per month — Includes 60 interview credits per month, up to 3 active job openings, and 24/7 email support with fast response times.
Enterprise and Agency plans are available upon request with custom pricing and features.

7.2 Interview Credits
Monthly Allocation. Each One Plan subscription includes 60 interview credits per month. Credits are allocated at the start of each billing cycle and expire at the end of that billing period. Unused monthly credits do not roll over to the next billing period.
Additional Credits. Once monthly credits are exhausted, additional interviews can be purchased at $3 per interview. Additional credits are valid for 12 months from the date of purchase. Older credits are consumed first (FIFO - first in, first out).
Credit Usage. Credits are deducted when an AI-powered interview is initiated through the Selectr platform. Failed or incomplete interviews will be refunded back to your account at our discretion.

7.3 Active Job Openings
The One Plan allows up to 3 concurrently active job openings. Additional openings require an upgrade to an Enterprise or Agency plan. Archived positions do not count toward this limit.

7.4 Trial Period
New clients receive a 30-day free trial of the One Plan. During the trial, you have full access to 15 interview credits per month and all platform features.
At the end of the trial period, you must add a payment method and purchase a subscription to continue using the Services. If no payment method is added, your account will be downgraded and access to the platform will be restricted.

7.5 Billing Cycle
The One Plan operates on a monthly billing cycle. Your first charge occurs when you purchase a subscription after the trial period ends. Subsequent charges recur every 30 days from the date of your initial purchase.
All subscription fees are charged to the payment method on file. We accept major credit cards.

7.5.1 Cancellation
You may cancel your subscription at any time. No refunds will be issued for the current billing period. Your access will continue until the end of the paid period.
Upon cancellation, any unused interview credits will be forfeited.

7.6 Price Changes
Selectr reserves the right to modify pricing with 30 days' written notice. Price increases will take effect at the start of your next billing cycle.

7.7 Taxes
Subscription fees and credit fees are exclusive of applicable taxes (sales tax, VAT, GST, etc.). You are responsible for paying any taxes that may apply to your subscription.

7.8 Refund Policy
Monthly Subscription Fees: Non-refundable. Cancellations take effect at the end of the current billing period.
Additional Interview Credits: Non-refundable once purchased, except in cases of platform errors or failed interviews where credits will be restored to your account.

7.9 Enterprise Billing
For enterprise and agency clients, alternative billing arrangements, including invoicing, may be agreed upon in writing.

8. Confidentiality

You agree to:

- Keep candidate data confidential;
- Restrict access to authorized personnel within your organization;
- Notify us promptly of any unauthorized access or breach.

9. Intellectual Property

All Selectr AI models, tools, content, and output are owned by us. You are granted a limited, non-exclusive, revocable license to use platform features solely for hiring purposes.

You may not:

- Copy or reproduce our models, prompts, or scoring tools;
- Use platform outputs to train other AI systems.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available". We do not guarantee:

- The accuracy of AI-generated insights;
- Hiring success;
- That the platform is error-free or always available.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

- Indirect, incidental, or consequential damages;
- Actions you take based on platform output;
- Data misuse or breaches once candidate data is transferred to you.

12. Indemnification

You agree to indemnify Selectr AI from any loss, damage, or claim arising from your:

- Misuse of candidate data;
- Violation of laws or these Terms;
- Negligence or misconduct.

13. Modifications

We may modify these Terms at any time. Continued use of the platform after such changes constitutes your acceptance. The current version will always be available at getselectr.com.

14. Termination

We may suspend or terminate your account at any time if you breach these Terms or misuse candidate data.

15. Governing Law

These Terms shall be governed by the laws of Georgia, and any disputes shall be subject to the exclusive jurisdiction of the courts in Tbilisi.
